South Seas Resort on Captiva Island is moving forward with redevelopment plans after a Lee County circuit judge upheld the county’s rezoning approval. The plans allow construction of two hotels with a combined 435 rooms and 193 additional dwelling units, despite opposition from the Captiva Civic Association.
A Lee County circuit judge rejected a legal challenge to the county’s rezoning approval for South Seas Resort on Captiva Island. In an Oct. 21 ruling, Judge James Shenko found that commissioners relied on substantial evidence, followed applicable law and provided the required due process. The Captiva Civic Association challenged the August 2025 approval, which allows construction of two hotels totaling 435 rooms and 193 additional dwelling units. The redevelopment would expand the resort beyond longstanding development limits following Hurricane Ian’s destruction of its former 107-room hotel in September 2022. The ruling leaves the county’s zoning approval in place.
